Can we break a 12 month lease for a house in AZ if nothing mentioned about leasebreakage in rental agreement?
We signed a 12 month lease for a house in AZ. Within a month we had water leakage outside and the sprinkles are not working automatically. We had a water leakage under the sink and in the bath tub. Dishwasher was scratching my stainless steel cookware and finally AC went off for a week. In Pheonix it is too much hot now and we all fell sick. We want to terminate the lease now and we still have 10 more months to go. Nothing has mentioned in the lease agreement about the lease breakage. Please help me..Thanks a lot..
Heather is correct on everything, however you will have to do a combination of things... you will need to triple check to make sure there is no clause or provision for early lease termination (this would be fantastically rare) AND cross check what it would mean by checking with your local housing authority. You can go to your local courthouse OR go to hud.gov and look up tenant laws for AZ. This will tell you everything you need to know.
Also, immediately begin writing down every incident you feel is making your stay there unworthy of continuing your lease agreement. Your word against the landlord's word will get you know where should you have to ask a judge about your situation... written records always trump memory.
And if you can prove (all it takes is a letter/bill from the electric company) that your a/c was out for that period of time, most states allow you to deduct the daily rental amount for each day your place is considered 'uninhabitable'... again, these criteria differ from state to state but hud can tell you.
it's going to be difficult to break it, but maybe not impossible...
